By accessing this website we assume you accept these terms and conditions. Do not continue to use bricktastics if you do not agree to take all of the terms and conditions stated on this page. Our Terms and Conditions were created with the help of the Terms And Conditions Generator.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.


Terms Of Service - Sell and Donate your LEGO®

Bricktastics – Sell Your LEGO Terms of Service

Effective Date: [3/25/2025]

By using Bricktastics’ “Sell Your LEGO” service, you agree to the following terms and conditions. If you do not agree, you must not proceed with the sale.


1. Eligibility

To use this Service, you must:

  • Be at least 18 years old or have a guardian with you to conduct the sale.

  • Have the legal right to sell the LEGO® items you are submitting.

  • Be located within Australia or a pre-approved location


2. Ownership and Authenticity

You confirm that:

  • You are the legal owner of the LEGO® items being sold.

  • The items are authentic LEGO® products with less than 20% non-LEGO items in the collection.

  • The items are not stolen, encumbered, or under dispute.

Bricktastics reserves the right to request proof of ownership and may report any suspected illegal activity to the appropriate authorities.


3. Assessment and Offer

  • Upon receiving your LEGO® items, Bricktastics will assess them based on weight, condition, completeness, and market value.

  • Bricktastics will then make a final offer, which may differ from any preliminary quote.

  • You will have the option to accept or reject the final offer. If rejected, items can be returned at your expense.


4. Right to Refuse or Terminate Sale

Bricktastics reserves the right to:

  • Refuse, suspend, or cancel any sale at any stage, for any reason, including but not limited to suspicion of fraud, improper packaging, misrepresentation, or non-compliance with these terms.

  • Seek compensation or legal remedy for damages caused by misrepresentation, fraud, or shipment of prohibited or dangerous goods.


5. Payments

  • Payments will be made by bank transfer or other agreed methods after the final offer is accepted and LEGO® has been received and inspected by Bricktastics.

  • Payments are typically processed within 3 business days but may be delayed in certain circumstances.

  • Once payment is made and confirmed, all ownership of the LEGO® items transfers to Bricktastics permanently.


6. Shipping and Risk

  • You are responsible for securely packing the LEGO® items to prevent damage in transit.

  • Bricktastics is not liable for any loss, theft, or damage during shipping unless otherwise agreed in writing.

  • Bricktastics will provide you with pre-paid shipping labels, or you can deliver the items yourself.


7. No Guarantee of Purchase

Submitting LEGO® to Bricktastics does not guarantee purchase. Bricktastics is under no obligation to buy any items and may reject them at our sole discretion.


8. Indemnification

You agree to indemnify and hold harmless Bricktastics, its owners, employees, and affiliates from any claim, demand, liability, or expense (including legal fees) arising from your breach of these terms, misuse of the Service, or violation of any law.


9. Limitation of Liability

To the maximum extent permitted by law, Bricktastics shall not be liable for:

  • Any indirect, incidental, or consequential damages;

  • Loss of profit or reputation;

  • Any claim exceeding the assessed value of your LEGO® items.


10. Amendments

Bricktastics may modify these Terms of Service at any time. Continued use of the Service after changes are made constitutes acceptance of the new terms.


11. Governing Law

These terms shall be governed by and interpreted under the laws of New South Wales, Australia. Any disputes will be handled in the courts of New South Wales.

12. Condition, Safety, and Liability for Harm Caused by Items Sold

You agree that it is your sole responsibility to ensure no harm or injury could arise from the sale or distribution of your LEGO® to Bricktastics and its customers/donation recipients. You agree that all LEGO® items sold to Bricktastics are in safe, clean, and reasonable condition, free from contaminants, objects, or modifications that could cause injury or harm. 
By submitting items for sale, you confirm that you have checked their condition and that they are safe for handling, resale, and use.

Bricktastics accepts no responsibility or liability for any injury, damage, or harm caused by items sold to us, whether occurring before or after resale or redistribution.
You agree to indemnify and hold harmless Bricktastics, its directors, employees, and affiliates from any and all claims, losses, damages, or legal action resulting from harm caused to any person or property as a result of items you sell or donate to Bricktastics.
This clause survives completion or termination of the transaction.



Terms Of Service - Sell and Donate your LEGO® Continued

Donations Policy

Bricktastics is one of Australia's Largest Donor's of LEGO®, building blocks and used toys in Australia. It is our promise that should you donate your LEGO® or Building blocks/toys to Bricktastics we will endeavour to match your Usable and acceptable condition LEGO® product kg for kg with suitable LEGO®, Building blocks, toys and or monetary donations equal to the value of your donation, amongst the schools, organisations, families and charities that we work with. Donations may be combined together with other donor bricks and may go to a single or several recipients based on how Bricktastics deems it most effective to distribute them and based on the needs of recipients at the time. All donations we receive either go directly to our donation program or help support Bricktastics to conduct its ongoing donation program and community programs.

Who We Donate To:
Bricktastics donates to a variety of organisations across Australia and Internationally. We prioritise organisations that work with children, often in groups and who lack the financial means or support to purchase these supplies themselves. This ensures that only the most needing organisations and groups of people can benefit from our donation program. These include but are not limited to, schools, community groups, charities, mental health groups, third-world villages and charity groups and more.

Best Home Policy:
Our Best home policy refers to Bricktastic's core mission to get "every brick to its best home", this means maximising each LEGO® piece's creative potential while homing it with a loving owner. This enables us to ensure that items not suitable for donation are able to find homes with more appropriate owners while still ensuring that your donation financially supports the sustainability of our ongoing donation program efforts. 

For example, some LEGO® donations may have adult themes, not be age-appropriate, or be of a condition or collectability that children would not find suitable for play, in these instances we will find more suitable homes and any proceeds with be used to support Bricktastics in continuing to donate 1000's of KGS's of LEGO® Bricks and Toys to charitable causes. 

Bricktastics does not include the weight of your booklets, or packaging in your donation calculations, we also do not include any items that we deem to be reasonably unusable by our donors, such as soiled items, or items that need to be discarded like rubbish.

Bricktastics cannot promise to send your donation to any specific organisation or cause of your preference or choice. We reserve the right to sort and donate your collection as we deem most appropriate to maximise its creative outcomes, and should in the event your donation incur Bricktastics with unexpected or unsustainable costs due to its processing, storage, transportation or similar, then Bricktastics may make the decision not to donate it. 


Accuracy of Information
Bricktastics strives to provide accurate and up-to-date information regarding product descriptions, pricing, and availability. However, errors may occasionally occur. Bricktastics reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. We also reserve the right to cancel or refuse any order placed due to errors in pricing, product availability, or any other relevant information, even after an order has been submitted.


Order Acceptance and Payment Terms
Bricktastics reserves the right to refuse or cancel any order at our sole discretion, regardless of order status. Reasons for refusal or cancellation may include, but are not limited to, product unavailability, errors in product or pricing information, or suspected fraudulent or unauthorized transactions. In the event of a cancellation, we will notify you promptly and issue a full refund if payment has already been processed. By placing an order, you agree to provide accurate and complete information, and you accept the possibility of order adjustments or cancellations under these terms.


Shipping and Delivery
Bricktastics aims to process and dispatch orders promptly; however, shipping times provided are estimates only and are not guaranteed. Delivery times may vary due to factors beyond our control, such as carrier delays, public holidays, or customs processing times. For international orders, customers are responsible for any applicable customs duties, taxes, or fees. Bricktastics is not liable for delays or additional charges that may arise during the shipping process.


User Accounts and Responsibilities
Users are responsible for ensuring the accuracy and security of information provided during account creation. You are solely responsible for maintaining the confidentiality of your account credentials and for any activities or actions that occur under your account. Bricktastics reserves the right to terminate, suspend, or restrict access to your account without notice if we suspect any misuse, unauthorized access, or breach of these Terms.


Liability Limitations
To the fullest extent permitted by Australian law, Bricktastics disclaims all liability for any direct, indirect, incidental, or consequential damages arising from or in connection with your use of the website, its content, or services. You acknowledge that you access and use this website at your own risk and that Bricktastics is not liable for any loss or damage incurred from errors, omissions, or interruptions in the content provided. This disclaimer does not affect any warranties or consumer rights that cannot be excluded under Australian law.

Limitation for Donations
Bricktastics will make reasonable efforts to process all donations in line with our "Best Home" policy. However, Bricktastics cannot guarantee that any specific donation will go to a particular individual or organization or produce specific outcomes. Bricktastics reserves the right to determine the best distribution channels for all donations and to vary our methods and outcomes if operational costs make it unsustainable to process any specific donation.


Governing Law and Jurisdiction
These Terms of Service and any separate agreements whereby we provide you services are governed by and construed in accordance with the laws of Australia. Any disputes arising from or relating to these terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
