Terms Of Service - Sell and Donate your LEGO® Continued
Donations Policy
Bricktastics is one of Australia's Largest Donor's of LEGO®, building blocks and used toys in Australia. It is our promise that should you donate your LEGO® or Building blocks/toys to Bricktastics we will endeavour to match your Usable and acceptable condition LEGO® product kg for kg with suitable LEGO®, Building blocks, toys and or monetary donations equal to the value of your donation, amongst the schools, organisations, families and charities that we work with. Donations may be combined together with other donor bricks and may go to a single or several recipients based on how Bricktastics deems it most effective to distribute them and based on the needs of recipients at the time. All donations we receive either go directly to our donation program or help support Bricktastics to conduct its ongoing donation program and community programs.
Who We Donate To:
Bricktastics donates to a variety of organisations across Australia and Internationally. We prioritise organisations that work with children, often in groups and who lack the financial means or support to purchase these supplies themselves. This ensures that only the most needing organisations and groups of people can benefit from our donation program. These include but are not limited to, schools, community groups, charities, mental health groups, third-world villages and charity groups and more.
Best Home Policy:
Our Best home policy refers to Bricktastic's core mission to get "every brick to its best home", this means maximising each LEGO® piece's creative potential while homing it with a loving owner. This enables us to ensure that items not suitable for donation are able to find homes with more appropriate owners while still ensuring that your donation financially supports the sustainability of our ongoing donation program efforts.
For example, some LEGO® donations may have adult themes, not be age-appropriate, or be of a condition or collectability that children would not find suitable for play, in these instances we will find more suitable homes and any proceeds with be used to support Bricktastics in continuing to donate 1000's of KGS's of LEGO® Bricks and Toys to charitable causes.
Bricktastics does not include the weight of your booklets, or packaging in your donation calculations, we also do not include any items that we deem to be reasonably unusable by our donors, such as soiled items, or items that need to be discarded like rubbish.
Bricktastics cannot promise to send your donation to any specific organisation or cause of your preference or choice. We reserve the right to sort and donate your collection as we deem most appropriate to maximise its creative outcomes, and should in the event your donation incur Bricktastics with unexpected or unsustainable costs due to its processing, storage, transportation or similar, then Bricktastics may make the decision not to donate it.

LEGO® BRANDING AND AFFILIATION
LEGO® is a trademark of the LEGO Group. Unless expressly authorised by the LEGO Group, the LEGO® name, logo and other LEGO® trademarks should not be used in a way that suggests that an event, promotion, product or organisation is sponsored, endorsed, licensed by, or affiliated with the LEGO Group. Where LEGO® branding is not necessary to accurately identify genuine LEGO® products or elements, we recommend using generic terms and imagery such as “construction bricks”, “building bricks” or “construction toys”.
Custom and Corporate Orders — Client Artwork and Use
Client-Supplied Artwork and Intellectual Property
Where a customer supplies Bricktastics with any logo, trademark, artwork, image, text, design, branding or other material (“Client Material”) for use in a customized product, the customer represents and warrants that it owns, or has obtained, all necessary rights, licenses, permissions and authorities to reproduce and use that Client Material for the requested purpose.
The customer is responsible for ensuring that Client Material supplied to Bricktastics does not infringe any copyright, trademark, design, intellectual property or other rights of any third party.
Bricktastics’ acceptance, reproduction, printing or application of Client Material does not constitute confirmation or legal advice that the customer has the right to use that material.
Third-Party Products and Brands
Some Bricktastics products may incorporate genuine products, components or elements manufactured by third parties.
Unless expressly stated otherwise by the relevant third party, the inclusion of a third-party product or component does not indicate or imply that the third party sponsors, endorses, authorizes, supports, partners with or is otherwise commercially affiliated with Bricktastics, the customer, the customer’s organization, or the customer’s promotion or event.
Customers must not use third-party trademarks, logos, branding or other intellectual property in connection with a Bricktastics product without obtaining any permission required from the relevant rights holder.
Customer’s Subsequent Use of Products
Following delivery, the customer is responsible for the manner in which customized products are advertised, promoted, displayed, distributed, represented, resold or otherwise used.
The customer must ensure that its use of the products complies with applicable laws and does not infringe the intellectual property or other rights of any third party.
Unless authorized by the relevant rights holder, the customer must not make any statement, representation or presentation that states or implies sponsorship, endorsement, authorization, partnership or other commercial affiliation with a third-party brand merely because that brand’s genuine products or components are incorporated into, displayed with or otherwise associated with the finished product.
Bricktastics is not responsible for representations, advertising, promotional material or other uses created or made independently by the customer after the products have been supplied.
Right to Refuse Artwork or Orders
Bricktastics reserves the right to reject, remove or require modification of Client Material, or decline an order, where Bricktastics reasonably believes that the requested material or use may infringe third-party rights, falsely imply an affiliation or endorsement, or otherwise be unlawful.
Bricktastics’ decision not to reject Client Material does not constitute confirmation that the material or proposed use is legally permissible.
Indemnity
To the extent permitted by law, the customer indemnifies Bricktastic Plastic Pty Ltd, its officers, employees and contractors against claims, liabilities, losses, damages and reasonable legal costs arising from:
(a) Client Material supplied or authorized by the customer infringing the rights of a third party;
(b) the customer’s unauthorized use of third-party trademarks, logos, branding or intellectual property;
(c) statements or representations made by the customer concerning sponsorship, endorsement, authorization, partnership or affiliation with a third party; or
(d) the customer’s advertising, promotion, distribution, representation or use of the finished products after delivery,
except to the extent that the relevant claim, liability, loss, damage or cost was caused by an unlawful act or omission of Bricktastics.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
MINIFIGURES AND CUSTOM BRANDING
The LEGO® Group holds intellectual property rights relating to the LEGO® Minifigure, including registered trademark rights in the Minifigure design in various jurisdictions. Bricktastics uses genuine LEGO® elements but operates independently of the LEGO Group and is not sponsored, endorsed, licensed by, or affiliated with the LEGO Group. Bricktastics does not apply client logos, trademarks or other custom branding directly to genuine LEGO® Minifigures.
Where custom branding is supplied, it is applied to separate elements that are not LEGO®-branded parts and are not part of the protected LEGO® Minifigure design. Clients remain responsible for ensuring that they have the necessary rights and permissions to use any logos, trademarks, artwork or other intellectual property supplied to Bricktastics for reproduction.
